1.         Introduction

1.1       You will be able to access most areas of this website without registering your details with us. Certain areas are only open to you if you register.

1.2       We may change these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the terms and conditions to make sure you have the most recent version relevant to your contract.

1.3       These terms and conditions are for Private Purchasers (consumers) only. For clarification a consumer is any person who does not deal in the course of their business.

1.4       If you are buying our goods to re-sell then you need to notify us in writing to open a re-seller account with us. Our contact details are on the first page of this document.

1.5       If you have any questions about these terms and conditions and how they affect you please contact telephone number 01522 726100.

2.         Buying/ Ordering  Products

2.1       You are deemed to have placed an order with us by ordering online via our online checkout process, or by placing an order over the telephone. As part of the checkout process you will be given the opportunity to check your order and correct any errors. We will send you an order acknowledgement detailing the products you have ordered. This will be done by e-mail.

2.2       We will accept your order when we CONFIRM the order by e-mail. Once the order is accepted the contract is formed.  We will send written confirmation of order via Royal Mail if you so request.

2.3       We may refuse to accept your order:

(a)        Where goods are not available, in which case we may provide a substitute of the same type and quality. You will be notified of this substitution by post or e-mail or telephone. You will have an opportunity to return the substitute goods if they are not acceptable. We will bear the cost of returning the substitute goods to our offices;

(b)        Where we cannot obtain authorisation for your payment;

(c)        If there has been a pricing or product description error; or

(d)        Where it is logistically impossible for us to deliver the goods to that location.

2.4       Delivery will take place within 28 days of the order being confirmed unless otherwise agreed with you. Orders placed on a Saturday, Sunday or Bank Holiday will be processed the next working day

3.         Prices

3.1       Prices listed are in GBP and are inclusive of VAT.

3.2       Latest prices are listed against each specific product on the website

3.3       Our prices are reviewed on a regular and frequent basis and any changes will be listed against each specific product on the site.

3.4       All prices must be paid in full before despatch. Payment can be made by credit or debit card; we accept visa, mastercard maestro, delta, amex, and solo and payment is taken when we receive your order. On-line and telephone order payments are processed via sec.net.

4. Cancellation and Returns Policy

4.1       If you wish to cancel your order before the goods have been despatched you can e-mail us at info@waddintonairshow.co.uk.

4.2       If you wish to cancel your order once you have received the goods you can give us a notice of cancellation. You have seven working days from the day after the date of delivery of the goods. You must notify us in a durable form and this can be done by email to info@waddintonairshow.co.uk. or in writing to Air Show Office, RAF Waddington, Lincoln, Lincs LN5 9NB. You must keep the goods in good condition whilst they are in your possession.

4.3       You should return the goods to us; you will bear the cost of returning the goods. Upon receipt of the good you will receive a full refund of any monies paid or exchange or credit if applicable.

4.4       In the case of customised orders where goods have been made specifically to your order the above cancellation provisions do not apply.

4.5       Refunds will be processed as soon as practicable but will be processed within a maximum 30 days. Where exchange rates of currency are involved, the refund will be made in GBP at the current exchange rate. It is not reasonable for us to accept responsibility for any loss or gain caused by changes in the exchange rate between the time of ordering and the time of issuing the refund.

NOTHING IN THIS SECTION AFFECTS YOUR STATUTORY RIGHTS

 

5.         Photographs and Images

5.1       Photographs and images on the website may have been supplied to us by the manufacturers, or with regard to our own products they will have been supplied by us but in any event they are used to represent the style of the product only.

6          Returns

6.1       If the product is damaged or broken on arrival you can return the goods. We will require photographic evidence of the condition of the item you are returning.  You will receive a full refund once the goods have been delivered to us and have been inspected.

6.2       If the product you receive is not what you ordered or does not correspond fully with its item description and you wish to discuss this please notify us immediately on 01522 726100 (Calls from BT landlines cost between 5 and 10 pence per minute. Callers in the UK pay the same call charges irrespective of National Geographic Location. Charges for calls from mobiles may vary).

6.3       If an item develops a fault within a reasonable period after delivery you should NOT continue to use the goods.  Please notify us as soon as practicable on 01522 726100 (Calls from BT landlines cost between 5 and 10 pence per minute. Callers in the UK pay the same call charges irrespective of National Geographic Location. Charges for calls from mobiles may vary) or email info@waddington.co.uk.  We will arrange for a replacement or refund as required. In both cases we will bear the cost of returning the goods to us.

YOUR STATUTORY RIGHTS ARE NOT AFFECTED

7.         Liability

7.1       These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English Courts.

7.2       These terms and conditions together with the privacy policy, security policy, any order, order acknowledgement and communications and payment method instructions, if any, are the whole agreement between you and us. If any provision or terms of these terms and conditions is found by any competent jurisdiction to be invalid the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

7.3       Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.

7.4       You must be over 18 years to purchase the Products and register with this website.

7.5       WIAS shall not be liable for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the reason for that failure is caused by circumstances beyond its reasonable control.

7.6       Nothing in these terms and conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence (as such terms is defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.

7.7       We have used our best endeavours to ensure that our website complies with UK laws. However, we make no representations that the materials on our website are appropriate or available for use in locations outside the UK. Those who visit our website from other locations do so on their own initiative and are responsible for compliance with all applicable laws.

7.8       You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

8.1       While we endeavour to ensure that the information on this website is correct we do not warrant the accuracy and completeness of the material on this website. 13.1     Each registration is for a single user only. We do not advise you to share your user name and password with any person nor with multiple users on a network.

13.2     Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password you should contact us immediately.

13.3     We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

 

14. Miscellaneous

14.1     Items bought by companies or individuals for trade or resale purposes will not have any warranty other than that provided by the original manufacturer. All products are sold for domestic use only.

14.2     Any warranty offered or implied is valid for goods within the United Kingdom.

14.3     You may not assign, sub-licence or otherwise transfer any of your rights under these terms and conditions.

14.4     We try to ensure that all information on this site is accurate. However, if an error does occur we will contact you as soon as we become aware of the error, to discuss whether you wish to continue with your order or not. If you cancel your order you will receive a full refund of any charges paid in advance.

TERMS AND CONDITIONS OF EVENT ENTRY TO RAF WADDINGTON INTERNATIONAL AIR SHOW 2012

 
1. Tickets are purchased for the Event.
 
2. All flying is subject to serviceability, availability, operational requirements and weather, therefore it may become necessary to vary the programme due to any of these
occurrences. Your statutory rights are not affected.
 
3. The Organiser reserves the right to cancel or postpone the Air Show should this be necessary in the interest of public safety or due to any event outside its control. If the Air Show is cancelled or curtailed due to circumstances beyond the Organiser's control, such as force majeure (for example, but not limited to, act of God, outbreak of hostilities, riot, civil disturbance, act or threatened act of terrorism, fire, explosion, flood, fog or bad weather, power failure, failure of telecommunications lines, theft or malicious damage), the Organiser will not be obliged to offer any refunds. Your statutory rights are not affected.
 
4. The Organiser reserves the right to refuse admission and to remove persons from the airfield for any reason where necessary in the interests of public safety. The Organiser may have to conduct security searches to ensure the safety of the persons at the Event
 
5. The Organiser is not responsible for any loss, injury or damage, howsoever caused, to the bearer except where any such loss, injury or damage is caused by the negligence of the Organiser, its employees or agents. Any claim for loss, damage or injury caused by the negligence of the Organiser, its employees or agents should be made to the Organiser within a reasonable time after the occurrence of the loss, damage or injury.
 
6. The Organiser is not responsible for any loss, injury or damage caused, to the bearer directly or indirectly as a result of the Organiser exercising its right of cancellation in
accordance with term 3 above.
 
7. In the interests of public safety, the Organiser reserves the right to refuse the ticket holder entry or request that the ticket holder leave the airfield at any time for safety
reasons or immediately after the Event.
 
8. The following items may not under any circumstance be brought onto the show ground:-
 
      a) explosive substances or materials, pyrotechnics, offensive weapons and firearms (including replica or toy firearms), projectiles and similar devices;
 
      b)placards, flags, banners and signs are prohibited together with brochures and leaflets that are intended for distribution to the public;
 
      c) megaphones, amplifiers, loud speakers, lights and laser pointers;
 
      d) paint, chemicals, spray cans; and
 
      e) any other item which, in the reasonable opinion of the Organiser, may cause personal injury or property damage, disruption to the Air Show, public nuisance or
inconvenience, offence or distress or security risks.
 
9. Children under 12 years of age must be accompanied by an adult.
 
10. In the interests of all spectators, Tents and Gazebos are not permitted in any part of the airfield.
 
11. No vehicle shall be permitted to remain in the car parks overnight and all vehicles must be removed from the car parks at the end of each day of the Event.
 
12. Motor-homes will be parked at the rear of the car parks, where sign posted.
 
13. During the Event, the airfield is classed as a public area and is subject to the normal rules and regulation that apply to public areas. A leaflet detailing these rules and
regulations will be handed out to visitors upon entry to the Event. Please note that this includes rules relating to the use of cars and general behaviour.
 
14. No person shall, without the Organiser's prior written consent, sell, licence, or attempt to sell or licence any material whether written or in the form of digital or
photographic film, sound, video or other recording on computer software, obtained or made at the Event.
 
15. By entering the airfield, the ticket holder is giving consent to being filmed or sound recorded for T.V., Video, DVD, Webcast or other public broadcast. RAF photographers
will be taking photographs for publicity purposes through the Event. These may include pictures of persons under 18 years of age, in which case, permission will be sought from parents or legal guardians prior to photographs being taken.
 
16. Strictly no trading is permitted on the airfield, other than that which is previously agreed with the Organiser.
 
17. Smoking is not permitted within the immediate vicinity of the aircraft. Please note that it is illegal to smoke inside buildings and enclosed structures.
 
18. These terms of conditions may be varied by the Organiser from time to time with reasonable notice.
 
THE BEARER'S STATUTORY RIGHTS ARE NOT AFFECTED
